He has 30 years of experience and holds several license certifications from the state and wildlife control trade groups.&lt;br /&gt;&lt;br /&gt;Obtaining a license as required by California prior to this ruling all applicants had to pass a 200-question pesticide examination and have two years’ experience in handling pesticides--and yet Mr. Merrifield doesn't even use pesticides.&lt;br /&gt;&lt;br /&gt;"Consumers no longer will have to take what is offered to them by the pesticide industry by putting up Decon or other poison baits in structures."&lt;br /&gt;&lt;br /&gt;"We are recommending that Consumers find the opening, close them and trap the animals out  and if they happen to be locked in provide one way doors to allow the animals leave on their own"&lt;br /&gt;&lt;br /&gt;"I have been fighting the use of pesticides in buildings for over 30 years. This is an issue near and dear to my heart."&lt;br /&gt;&lt;br /&gt;"The good news is that Wildlife controllers don't have to take it anymore. There are more and more  legal precedents out there to help fight the system.We no longer have to go out and hide behind the trees anymore. We should be able to go out and pursue the occupation of our choice. We have a Constitutional right to do that and now be able to express those rights"&lt;br /&gt;&lt;br /&gt;California law required that Merrifield also get a “Branch 2 Structural Pest Control Operators’ License” to use nonpesticide techniques on pigeons, rats, and mice.  (Yet No license was required for treating other vertebrate pests, like bats, raccoons, or skunks.)&lt;br /&gt;&lt;br /&gt;This unreasonable licensing rule was designed simply to protect established pest control companies against fair competition by Mr. Merrifield, the judges held, and ruled that was not a legitimate goal for the government to pursue.  This important victory has now helped clear the way for entrepreneurs to pursue their constitutional right to earn a living.&lt;br /&gt;&lt;br /&gt;For wildlife controllers and other business entrepreneurs they need to go to the web site of the Legal Foundation &lt;a href="http://www.pacificlegal.org"&gt;PacificLegal.Org&lt;/a&gt; and review his case. below you find a letter posted by Alan to &lt;a href="http://www.wildlifepro.net"&gt;The Wildlife Pro Network&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;Fellow Wildlife Control Operators,&lt;br /&gt;&lt;br /&gt;It is my distinct honor to inform you that the California CO Association has won another legal battle in defense of our constitutional right to earn an honest living without having to overcome undue government interference.&lt;br /&gt;&lt;br /&gt;On January 6th, the Ninth United States Circuit Court of Appeals rejected the State's petition for en banc hearing of our case. Had 14 judges approved the State's request, we would have had to file another brief and make still another oral argument before an 11 judge panel. But that's not going to happen now. Unless the State of California decides to file a Writ of Certiorari asking the United States Supreme Court to intervene, this case is over after a very long six year series of courtroom battles.&lt;br /&gt;&lt;br /&gt;This legal victory represents the very first time since 1868 that an state occupational licensing law was overturned and found unconstitutional. It is only the second time in the entire history of the United States that the Fourteenth Amendment to the Constitution has been used to smash a state-sponsored cartel. This was truly a David versus Goliath encounter where David kicked ass again.&lt;br /&gt;&lt;br /&gt;The case of &lt;a href="http://www.positiveliberty.com/2007/08/my-ninth-circuit-argument-in-an-economic-liberty-case.html"&gt;Merrifield v Lockyer&lt;/a&gt; is a landmark case establishing a number of legal precedents. important to entrepreneurs in general and Wildlife Control Operators in particular. One of those who first benefited from this program then was Charles Parker, &lt;a href="http://www.parkerwildlifecontrol.com"&gt;Parkerwildlifecontrol.com&lt;/a&gt; , who services the New Orleans, Louisiana area.&lt;br /&gt;&lt;br /&gt;Another NWCO (nuisance wildlife operator) who was called up and deployed to IRAQ and his family needed heat for their home! WOAF was able to put that soldiers mind at ease and help a NWCO's family ride it through what would of been a cold winter. Lockyer case. He was the lawyer that both tried it and won it. He carried the sword and led the fight for not only the rights of Wildlife Controllers but the rights of every American citizen.&lt;br /&gt;&lt;br /&gt;The Pacific Legal Foundation is a non-profit legal foundation that provides free legal representation to folks like Alan Merrifield, of Urban Wildlife Control In California.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://skinnymoose.com/wildlifepro/2009/01/20/champion-of-entrpreneur-rights/pacific-legal-foundation/" rel="attachment wp-att-223"&gt;&lt;img src="http://skinnymoose.com/wildlifepro/wp-content/uploads/2009/01/pacific-legal-foundation.jpg" alt="pacific-legal-foundation" title="pacific-legal-foundation" width="150" height="150" class="alignnone size-full wp-image-223" /&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;The Pacific Legal Foundation defends private property rights and economic freedom in courts, seeking to establish important legal precedent that all entrepreneurs and property owners can use to protect themselves against government intrusiveness.&lt;br /&gt;&lt;br /&gt;I personally took a special interest in this case since it spelled out to the State of California that there business regulations requiring wildlife control professionals to possess a “Branch 2 Structural Pest Control Operators’ License” to use non-pesticide techniques on pigeons, rats, and mice was declared unconstitutional. (Yet No license was required for treating other vertebrate pests, like bats, raccoons, or skunks.) This unreasonable licensing rule was designed simply to protect established pest control companies against fair competition by Mr. Merrifield, the judges held, and ruled that was not a legitimate goal for the government to pursue. Had 14 judges approved the State's request, we would have had to file another brief and make still another oral arguement before an 11 judge panel. But that's not going to happen now. Unless the State of California decides to fle a Writ of Certiorari asking the United States Supreme Court to intervene, this case is over after a very long six year series of courtroom battles.&lt;br /&gt;&lt;br /&gt;This legal victory represents the very first time since 1868 that an state occupational licensing law was overturned and found unconstitutional. It is only the second time in the entire history of the United States that the Fourteenth Amendment to the Constitution has been used to smash a state-sponsored cartel. This was truly a David versus Goliath encounter where David kicked ass again.&lt;br /&gt;&lt;br /&gt;The case of Merrifield v Lockyer is a landmark case establishing a number of legal precedents. important to entreprenuers in general and Wildlife Control Operators in particular. I will be organizing my thoughts and will be speaking out on the meaning of this groundbreaking news in the near future. It’s truly amazing to hear from everyone. With that said we walked in together and I told him to stand where the arrow shows him standing. I kind of briefed him on where to look for the fox that would probably either come in across the road or up the ATV trail by the radio tower. I never took the time to actually point out where not to shoot. I took it for granted that he knew even though he had never hunted this spot. I then said I am going to hang the caller by the tower and then dip over the hill to the right to cover the down wind side of the caller. I got set up where the arrow shows me being set up. When I first got set up I looked in John’s direction but could not see his head lamp but I knew where he was and was confident he knew where I was.&lt;br /&gt;&lt;br /&gt;The first call I played on the caller was a recording of a hand call being blown. John immediately thought that I had changed the set up and was standing on top of the hill by the caller because the hand call recording sounded like my hand calls. After about ten minutes of calling I had a fox come in from the back of the property and was about to shoot it when, unbeknownst to me, John had a fox that came in between him and the caller. But since he thought I was on the other side of the caller he waited for another shot. When he finally lined the shot up, I was on the other side of the brush from him in a dip and he never knew it since he didn’t see my headlamp. &lt;br /&gt;&lt;br /&gt;His first shot peppered the side of my coat and I turned towards him to yell and it was too late. I heard the second shot ring out and could hear the bb’s ripping though the brush towards me. I started turning my face back to the right but it was too late. I took many pellets to the face, neck, arm, leg and my left eye. I hit the ground and screamed that I had been hit. When John came up I went unconscious. Once I came to, I called the land owner for help and we walked out. &lt;br /&gt;&lt;br /&gt;The ambulance took me from Prattsburgh to Strong hospital, which seemed like forever away. All in all hind sight is always 20/20 but can’t dwell on that. This was an accident and I don’t blame John, my hunting buddy for, or myself. It was a fluke and I just hope everyone can learn from it.&lt;br /&gt;&lt;br /&gt;All in all I took 15 or so pellets in my body. One is lodged between my jugular and carotid artery, one is on the outside of my voice box, and one grazed a ¾-inch gash across my left eye. The rest of the pellets are in my neck, arms, face, leg, chest, and hand. I truly am lucky to be alive and owe it to the many of you have have kept me in your thoughts and prayers.&lt;br /&gt;&lt;br /&gt;I don’t want to hear what could have been done different or how things could have gone differently. Hearing that stuff will just slowly kill John and I. Just have to be thankful that I am still here to tell about it so everyone can maybe slow down when making a set and talk a bit more about shot directions and such. &lt;br /&gt;&lt;br /&gt;The hospital left every BB in me since the risk of removing them was too great. Within my clothing was probably another 20 pellets that welted me but thank god didn’t completely penetrate into my body. The distance of the shot was ~ 65 yards. &lt;br /&gt;&lt;br /&gt;The whole night was a nightmare and one I don’t want to ever repeat or hear of being repeated by anyone else. It has been very trying on my family and friends. Just have to thank the Lord that I made it. &lt;br /&gt;&lt;br /&gt;As for my eye, the Dr’s are going to attempt several surgeries to fix it so I just have to remain positive about that. &lt;br /&gt;&lt;br /&gt;As for this post, please feel free to copy and past it where ever you see fit so both the non-hunting community and hunting community can all learn from it. I have heard many things that have been posted on the web about that night, and until you hear it first-hand you can’t believe any of it for a second. I just can’t believe some of the stuff being posted, makes me sick... &lt;br /&gt;&lt;br /&gt;Thanks again for everyone’s positive support.
